OMAZE PROMOTION OFFICIAL RULES

NO PURCHASE, PAYMENT OR DONATION OF ANY KIND IS NECESSARY TO ENTER THE PROMOTION AND WIN A PRIZE. A PURCHASE, PAYMENT OR DONATION IN RELATION TO AN ENTRY WILL NOT INCREASE YOUR CHANCES OF WINNING. RESIDENTS OUTSIDE OF THE UNITED KINGDOM EXCLUDED.

The promoter of the prize draws (the Promotion) is Omaze, Inc., a company incorporated in Delaware with registered number 453767670 and registered office at 5735 W Adams Blvd, Los Angeles CA 90016 (the Promoter, Omaze, we, or us). Entries to the Promotion are void where prohibited by applicable law and entrants that submit entries that are prohibited by applicable law shall not be entitled to receive a Prize. The Promotion is governed by these Omaze Promotion Official Rules (Official Rules).

By entering any of our prize draws (together, the Promotion), all participants will be deemed to have accepted and agreed to the terms of these Official Rules, our Terms of Use (the Terms) and our privacy notice (Privacy Notice). All entry instructions form part of these terms and conditions.

The Promotion will be separated into the following prize draws:

Four early bird prize draws, where one winner is drawn for each, culminating in the final winner being awarded a grand prize (Grand Prize Promotion);
a weekly prize draw, where a winner is drawn each week and awarded a cash prize (Weekly Cash Prize Promotion).
occasional short-term "flash draw" prize draws, where a winner is drawn from all valid entries during the "flash draw" period (Flash Draw Promotions)

If you make a monetary payment to us to enter the Promotion (an Entry Fee), we will donate at least 80% of the Net Proceeds to the applicable Charity (each a Donation) with a guaranteed minimum Donation of £70,000 irrespective of sales. Net Proceeds means 100% of your Entry Fee, minus the costs associated with providing the Prizes, and the reasonable costs of marketing and operating the Promotion. We do not deduct our salaries or central overheads from the Donations. In relation to the Million Pound House Draw Promotion, all Donations will be passed on to Teenage Cancer Trust (Charity) as outlined in these Official Rules.

Timing:

The Grand Prize Promotion will be conducted as six (6) periodic prize draws with separate entry periods (Grand Prize Draw Periods), drawing schedules (Drawings) and prizes (Prizes) as set forth in Table 1 below.

All entries to the Grand Prize Promotion received during the Grand Prize Draw Periods will be automatically entered into all applicable Drawings for the Grand Prize Promotion.

The Weekly Cash Prize Promotion will be conducted as twenty nine (29) periodic prize draws with separate entry periods (Weekly Cash Prize Draw Periods), Drawings and Prizes as set forth in Table 2 below.

All entries to the Weekly Cash Prize Promotion received during the Weekly Cash Prize Draw Periods will be automatically entered into all applicable Drawings for the Weekly Cash Prize Promotion.

The Flash Draw Promotions will be conducted as a limited number of short-term prize draws with separate entry periods (Flash Draw Periods). The opening and closing dates for each Flash Draw Promotion (which will include extended periods to allow for postal entries), and the Prize(s) available (including prize descriptions and any applicable restrictions), will be clearly publicised on the marketing materials for each Flash Draw Promotion.

All entries to the Flash Draw Promotions received during the Flash Draw Periods will be automatically entered into the applicable Drawing for the Flash Draw Promotion.

Prize Details:

Two thousand and twenty (2,020) additional prizes (Additional Grand Prizes) will be awarded in this Promotion, and thus two thousand and twenty (2,020) additional winners will be chosen after the Grand Prize has been awarded. Odds of winning depend on the number of entries received.

The following Prizes will be awarded in connection with the Drawings as outlined in the Drawing schedule above.

Grand Prize Promotion: Grand Prize Drawing

The grand prize (the Grand Prize) shall consist of the advertised property described below.

The Grand Prize consists of (i) the home located in Cheshire (the Property) (excluding home furnishings, artwork, and merchandise contained therein) (approximate retail value (ARV): £1,150,000) and (ii) £10,000 for first year running costs associated with the Property. Actual value of the Property depends on market fluctuations. Omaze will settle the following taxes and costs incurred by the winner of the Grand Prize in relation to their acceptance and use of the Grand Prize: stamp duty land tax (estimate £95,000); reasonable conveyancers fees (estimated £5,000).

The specifics of all elements of the Grand Prize in the Promotion shall be solely determined by Promoter. Some restrictions may apply. The Grand Prize cannot be transferred, substituted or redeemed for cash except at the Promoter’s sole discretion. The Promoter reserves the right to substitute all or part of the Grand Prize with a prize of comparable or greater value. The Grand Prize winner will be eligible to win multiple Prizes in the Grand Prize Promotion (for example, the Cheshire House and the Mini Electric Cooper S) but will not be eligible to win any other grand prize or main prize (determined by the Promoter, acting reasonably) of any other campaign or promotion at omaze.co.uk (the Site) for a period of eighteen (18) months from the date that the winner is notified that they have won the Grand Prize.

The following Additional Grand Prizes shall also be awarded in the Grand Prize Drawing in the order in which such winners are selected after the Grand Prize winner:

One thousand nine hundred and seventy (1,970) Gift Cards, ARV: £20 each

Early Bird Prize 4: The following prize shall be awarded to one winner: one (1) 2020 model year Tesla Model 3 Long Range (ARV £50,000).

Early Bird Prize 5: The following prize shall be awarded to one winner: one (1) cash prize of £10,000.

Weekly Cash Prize Promotion: Drawings

For each weekly Drawing outlined above, one winner will receive £1,000 in a cash payment.

Flash Draw Promotions: Drawings

For each Flash Draw Promotion Drawing, the Prize(s) available will be clearly publicised on the marketing materials for each Flash Draw Promotion, including prize descriptions and any applicable restrictions.

ADDITIONAL RULES

Entrant Eligibility:

The Promotion is open to entrants who are at least 18 years of age and resident in the United Kingdom.

Employees, officers, and directors of the Promotor or the Charity or any of their respective parents, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and website providers and members of their immediate families (spouses, parents, siblings and children) living in the same household are not eligible to enter or win. Participation in the Promotion constitutes the entrant’s full and unconditional agreement to these Official Rules, the Terms and to the Promoter’s decisions, which are final and binding in all matters related to the Promotion except as set out on these Official Rules and the Terms.

How to Enter:
There are two ways to enter the Promotion:

(1) Paid Method of Entry. Visit omaze.co.uk and select the enter now button. Choose your Entry Fee amount(s). Each Entry Fee amount will come with a set number of entries into both the Grand Prize Promotion and the Weekly Cash Prize Promotion (and, if applicable, a Flash Draw Promotion). Follow the instructions to enter your name, contact and payment information, and complete your payment. Once your payment is complete, you will automatically receive the number of entries you selected. You can enter by paying an Entry Fee as many times as you wish.

(2) Alternate Method of Entry. Print your full name, address (no post office box addresses accepted), city, post code, date of birth (dd/mm/yyyy), phone number and email address on either a postcard or letter. Post the completed entry to: Omaze Scrutineers, Civica Election Services, 33 Clarendon Road, London N80NW. Limit one entry per outer mailing envelope or postcard. Each entry made via the Alternate Method of Entry will automatically qualify for both the Grand Prize Promotion and the Weekly Cash Prize Promotion (and, if applicable, a Flash Draw Promotion) with effect from the date that an entry is received and processed. No mechanically reproduced entries are permitted. Illegible entries are void. Omaze is not responsible for lost, late, mutilated, delayed, inaccurate, incomplete, postage due, misdirected entries or entries not received by the last day of the applicable entry period.

Each entry received via the Alternate Method of Entry will be equivalent to a single entry into each of the Grand Prize Promotion and the Weekly Cash Prize Promotion (and, if applicable, a Flash Draw Promotion) that may be awarded via paying an Entry Fee.

You must provide all required information to be eligible to enter and win. Automated entries or entries submitted by third parties on your behalf will be disqualified. Entries must be submitted by the participant. No copies, facsimiles, or mechanical reproductions of entries will be accepted.

By entering this Promotion, you agree that the Promoter or its representative may contact you via email, phone, and mail in connection with this Promotion.

Winner Selection Process:
On or about the Drawing date specified in the Timing section above, Civica Independent Scrutineers will select the number of winners stated above (Conditional Winner(s)) by random drawing by either independent adjudicator or automated computer programme from all eligible entries received on the applicable Drawing Date from all eligible entries. Odds of winning depend on the number of entries received. Conditional Winner(s) will be notified by email or phone on or about the date specified in Timing. Winners will be announced within 14 business days of the specified draw date.

No person is a winner (Winner) of this PROMOTION, and no person may receive any prize, until they have satisfied all requirements of these OFFICIAL Rules, been verified by THE PROMOTER or its representative and been notified of such completed verification. During verification and except where legally prohibited, Conditional Winners may be required to sign paperwork confirming their eligibility and their ability to participate on given dates relevant to the Prize (if applicable), as well as other legal releases as may be reasonably required by the Promoter. Omaze may also perform background screenings or security checks, at its discretion, and the Conditional Winner agrees to sign any necessary documentation required for such checks.

If the Promoter is unable to contact the Conditional Winner within 5 working days in the United Kingdom, or if the Conditional Winner fails to sign and return any required paperwork within the reasonably required time period (if applicable), or in the event Conditional Winner is disqualified for any reason, the Promoter will award the applicable Prize to an alternate winner selected by random drawing from among all remaining eligible entries. This process will repeat until the Prize is awarded.

Additional Terms Governing Prize(s):

Unless expressly stated otherwise herein, any and all applicable taxes and all fees and expenses related to acceptance and use of a Prize not specifically stated herein are the responsibility solely of Winner(s). The Promoter will not replace any lost or stolen Prizes or components of a Prize(s). Prizes cannot be used in conjunction with any other promotion or offer. Only the number of Prizes stated in these Official Rules is available to be won in the Promotions.

Requirements to Redeem Certain Prizes Involving Vehicles

Omaze will settle the following taxes and costs incurred by the winner of any Prizes involving vehicles in relation to their acceptance and use of the Prize: title costs, licence fees, registration fees. Winner will be solely responsible for any additional equipment/accessories not specified in the Terms or these Official Rules, insurance, fuel, vehicle maintenance and all other fees and expenses associated with the receipt and use of any vehicle-related Prize. Actual Prize vehicle to be awarded is not the vehicle depicted in advertising but is of similar specification. The Winner may be required to show proof of valid insurance and driver’s licence prior to receipt of the vehicle. The Winner must take delivery of vehicle at a location and time of Omaze’s sole choosing. Omaze reserves the right to delay vehicle delivery or substitute a similar vehicle of equal or greater value should the vehicle as described be unavailable for any reason.

Transparency:

At Omaze, we believe fundraising should be about impact, not percentages. Our model allows us to really make a difference and change the way society traditionally thinks about charitable giving.

Omaze offer incredible prizes and experiences that anyone can potentially win. You don’t have to make a payment to enter, but if you do, 80% of the Net Proceeds, will be used to make a Donation to the Charity. Irrespective of total payments received Omaze will donate a minimum of £70,000 to the Charity.

General Conditions:

Participation constitutes the entrant’s agreement to these Official Rules. The Promoter, and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, corrupt, or illegible entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions beyond their reasonable control whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry will not be deemed proof of receipt by the Promoter. The Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Warning: any attempt by an entrant or any other individual deliberately to damage any website associated with this Promotion or undermine the legitimate operation of the Promotion may be a breach of criminal and civil law, and, should such an attempt be made, the Promoter reserves the right to claim against and seek damages from any such person to the fullest extent permitted by law. The Promoter reserves the right to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, the Site, and/or the legitimate operation of the Promotion; to breach the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Promotion cannot be run as planned, the Promoter may, in its sole discretion, void any suspect entries and (a) cancel or terminate the Promotion (or any portion thereof); (b) modify the Promotion or suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the Prize at random from among the eligible, non-suspect entries received up to the time of the impairment.

Limitation of Liability; Release:

By participating in the Promotion, you agree that Facebook, Twitter, Instagram, and their respective parent companies, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing, website providers, web masters, and their respective officers, directors, employees, representatives, and agents (the Released Parties) will have no liability whatsoever for, and shall be held harmless by you against, any liability for any injuries, losses or damages of any kind to persons, including personal injury or death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of the Prize, entry, or participation in the Promotion or in any Promotion related activity, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery, in each case except to the extent such liability cannot be excluded by law. The Released Parties are not responsible if any Prize cannot be awarded due to cancellations, delays, or interruptions due to acts of god, acts of war, natural disasters, weather, or terrorism. By participating in the Promotion, entrant agrees that the Released Parties will not be responsible or liable for any injuries, damages, or losses of any kind, including direct, indirect, incidental, consequential, or punitive damages to persons, including death, or to property arising out of access to and use of any website associated with the Promotion or the downloading from and/or printing material downloaded from such site.

Publicity:

Omaze reserves the right to publish or make available information that indicates that a valid award took place for each of the Prizes – for example, the surname and country and county of residence of the Winner. Affected Prize winners have the right to object to all or part of this information being published or made available – in such event they should inform Omaze in writing. In such circumstances, entrants acknowledge that Omaze must nevertheless still provide the information and winning entry to the ASA or equivalent regulator on request.

Omaze will also require that winners participate in any reasonable publicity required by Omaze.

Disclaimer of Warranties:

Except for those warranties implied by law which cannot be disclaimed, Omaze makes no warranty as to the quality, accuracy, completeness or reliability of any content available through the Site, the Software or the Service (each as defined in the Terms). You are responsible for verifying any information before relying on it. Omaze does not warrant that you will be able to access or use the Site, the Software and/or the Service at the times or locations of your choosing; that the operation of the Site, the Software or the Service will be uninterrupted or error-free; that defects will be corrected; that the Site, the Software or the Service is free of viruses or other harmful components.

Except for those warranties implied by law which cannot be disclaimed, Omaze provides no warranty or guarantee of any kind that the Site, the Software or the Service will meet your expectations or requirements.

This Promotion is not sponsored, endorsed, approved, or affiliated with the manufacturer of the Prizes(s) being awarded. Prize names and logos are the trademarks and property of the manufacturer of the Prize(s). Actual Prize(s) to be awarded may not be identical to those depicted which are intended to be only representative.

Privacy:

Information collected from entrants (and Guests, if applicable) is subject to the Promoter’s Privacy Notice.
