TERMS OF ACCEPTANCE | GIFT CARDS

By claiming the gift card prize (“Prize”) from Omaze UK Limited (“Promoter”), you confirm that: (i) you are solely responsible for all expenses associated with your use or acceptance of the Prize, including taxes; (ii) Promoter does not expect to withhold any amount of tax in respect of the Prize or remit any amount of tax to a taxing jurisdiction on your behalf; (iii) you meet all of the eligibility requirements to be awarded the Prize as set forth in Section 4 of the Official Rules; (iv) you have fully complied with these terms, the Official Rules, the applicable Prize Draw Experience Rules, and Terms of Use (collectively, together with these Terms of Acceptance for Gift Cards, the “Terms”); (v) you may be disqualified as the winner of the Prize if Promoter determines that you have failed to so comply with the Terms or if you are otherwise subject to disqualification under the Terms; and (vi) you consent to the transfer of your personal data to Omaze, Inc. (“Omaze US”), the parent company of Promoter located in the United States, as well as Promoter’s Service Providers with the understanding that your personal data will be used by Omaze US as necessary to fulfill the Prize and process any necessary legal and tax paperwork. Promoter does not make, and hereby disclaims, all representations and warranties of any kind, express or implied, with respect to the Prize, including warranties of merchantability and fitness for a particular purpose. Subject to your receipt of the Prize, you agree to indemnify, hold harmless, release, and discharge Promoter from any and all losses of any kind directly or indirectly arising out of, or in connection with your acceptance, use, misuse, or loss of the Prize. The Terms constitute your and Promoter’s entire agreement on the subject matter thereof. If it is determined by a court of competent jurisdiction that any provision of the Terms is invalid or unenforceable, then the remainder of the provisions of the Terms shall not thereby be affected and shall be given full effect, without regard to the invalid portions.
