OMAZE COTSWOLDS IV 2024 FACEBOOK PROMOTION RULES

NO PURCHASE, PAYMENT, OR DONATION OF ANY KIND IS NECESSARY TO ENTER THIS PROMOTION OR WIN A PRIZE. ALL ENTRIES INTO THIS PROMOTION HAVE AN EQUAL CHANCE OF WINNING. RESIDENTS OUTSIDE THE UNITED KINGDOM EXCLUDED.

1. THE PROMOTER: Omaze UK Limited (“Omaze” or “Promoter”).

2. ELIGIBILITY: To be eligible to enter or be awarded a prize in the “Omaze Cotswolds IV 2024 Facebook Promotion” (the “Promotion”), a Participant in the Promotion (a “Participant”) must fully comply with these Omaze Cotswolds IV 2024 Facebook Promotion Rules (the “Rules”). The Promotion is only open to individuals who at the time of entry to the Promotion and at the time the Winner(s) (as defined below) are selected (i) are legal residents of the United Kingdom who are aged 18 years or older; (ii) have an active and valid Facebook account (as set out below at Section 5, below); (iii) are not a Prohibited Person (as defined in the Official Rules); and (iv) are eligible to enter the Cotswolds IV House Grand Prize Prize Draw (as defined in the Cotswolds IV House Experience Rules) in accordance with the Official Rules and the Cotswolds IV House Experience Rules.

This Promotion is subject to all applicable international and local laws and regulations and is void where prohibited. These Rules form a binding contract between Promoter and each Participant. Participation constitutes Participant’s full and unconditional agreement to these Rules and Promoter’s decisions, which are (subject to Section 10 below) final and binding in all matters related to the Promotion. To be eligible to enter this Promotion or be awarded the prize(s) identified in Section 3 below, a Participant must fully comply with these Rules. IF YOU DO NOT AGREE TO THESE RULES DO NOT ENTER THIS PROMOTION.

3. DEADLINE TO ENTER/ ENTRY PERIOD: This Promotion (the “Cotswolds IV 2024 Facebook Promotion Drawing”) to win the prizes (each a “Prize”) identified in Table 1 below shall be conducted as one (1) prize draw (a “Drawing"). The promotion entry period (“Promotion Entry Period”) is detailed in Table 1 below and will commence at 00:00:01 (GMT or BST, as applicable) and end at 23:59:59 (GMT or BST, as applicable) on the first and last date (as applicable) of the Promotion Entry Period set out therein. Only those entries received by Promoter during the Promotion Entry Period will be valid. Promoter is the official timekeeper.

4. PRIZE DETAILS: The following Prizes will be awarded in connection with the Drawing(s) as outlined in the Drawing schedule above in Section 3, above. Unless noted in the Prize details in this Section 4, Winners are solely responsible for all taxes, costs, and fees associated with Prize receipt, ownership, and/or use. To accept the Prizes, Winners must accurately complete and timely return all documentation required by the Promoter, and failure to complete and timely return any required documentation within a reasonable time, or such other time period expressly provided by Promoter in writing, may result in disqualification.

Prize 1. One Prize Winner shall be awarded a £150.00 GBP Gift Card for the Omaze Website (as defined below).
Prize 2. One Prize Winner shall be awarded a £50.00 GBP Gift Card for the Omaze Website.
Prize 3. One Prize Winner shall be awarded a £25.00 GBP Gift Card for the Omaze Website.

The Winners of Prize 1, Prize 2 and Prize 3 are each a “Winner” and collectively the “Winners”. Each Winner will receive their Gift Card Prize via email at the valid email address provided by the Participant when entering the Promotion. The Gift Card Prizes can be redeemed at Omaze.co.uk (the “Omaze Website”) in accordance with the Omaze Gift Card and Reward Code Terms of Use. The Gift Card Prizes, including any unused Gift Card Code balances, expire twelve (12) months from the date of issuance. Notwithstanding any terms in the Omaze Gift Card and Reward Code Terms of Use, Gift Card Prizes cannot be exchanged for money and can only be redeemed at the Omaze website. No cash alternatives of the Prizes will be offered.

5. HOW TO ENTER: During the Promotion Entry Period, Participants shall enter the Promotion by completing the following steps:

Participant shall like Promoter’s designated social media post(s) (the “Posts”); and
Participant shall thereafter insert the following information in the Google Document linked to in the Posts:

full name;
valid email address; and
a correct answer to the relevant question included within the Google Document.[i]

Participants must have an active and valid Facebook account in order to enter the Promotion.

Each eligible Participant that successfully completes these entry requirements with the information required for the entry equals one (1) entry. Entries submitted by Participants that do not have an active and valid Facebook account and/or that do not comply with the entry requirements set out in these Rules are not valid entries for the Promotion.

Participant understands and acknowledges that Participant is solely and fully responsible for any content posted by Participant in connection with the Promotion (an “Participant Post”). Participant further confirms that its Participant Post(s) will:

comply with these Rules, and the rules of the Facebook platform(s);
not include or use the intellectual property of other parties, including any third party music, photographs, artwork, trademarks, logos, or slogans;
not include any person, or personally identifiable information about anyone, other than the Participant; and
not include content that is unlawful, defamatory, discriminatory, obscene, offensive, harassing, or has the purpose or effect of creating an intimidating or hostile environment.

6. ENTRY LIMITATIONS AND RESTRICTIONS: There is a limit of one (1) entry per Participant. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated. Using multiple social media accounts, identities, or devices in an attempt to circumvent these Rules is strictly prohibited. Multiple Participants are not permitted to share the same Facebook account. Individuals who do not follow all of the instructions, provide all required information, and/or abide by these Rules or other reasonable instructions of Promoter may be disqualified by the Promoter.

Odds of winning will depend on the number of entries the Promoter receives for the Promotion.

7. WINNER DRAWING(S): On or after the Draw Date specified in Section 3, above, potential Winner(s) will be selected for each Drawing using a verifiably random process from among all eligible entries received. Potential Winners will be notified via email.

Prize will only be awarded to a verified and eligible Winner and may not be assigned. All potential Winners are subject to verification, including verification of age. If a potential Winner cannot be verified, or is found by Promoter to be (i) ineligible, (ii) not in compliance with these Rules, (iii) non-responsive, or (iv) unable or unwilling to accept and claim the Prize as stated, or if any required documents are not timely returned within the required number of days, then the potential Winner may be disqualified, and the Prize may be forfeited in Promoter’s reasonable discretion. In the event that a potential Winner is disqualified for any reason, Promoter reserves the right to award the Prize to an alternate Participant who will also be selected in a manner that is fair and equitable.

8. PUBLICITY: Omaze reserves the right to publish or make available information that indicates that a valid award took place for the Promotion – for example, the name, surname and country of residence of the Winner(s) on Facebook. Winner(s) have the right to object to all or part of this information being published or made available – in such event Winners should inform Omaze in writing. In such circumstances, Winners acknowledge that Omaze must nevertheless and where required, still provide the information and winning entry to the ASA or equivalent regulator on request. Omaze will also require that Winners participate in any reasonable publicity required by Omaze.

9. GENERAL CONDITIONS: Omaze reserves the right to cancel, suspend, and/or modify a Promotion, in whole or in part, due to any fraud, bugs, virus, technical failures, changes in the law, or any other factor beyond Omaze’s reasonable control that impairs the compliance or integrity or proper functioning of a Promotion, as reasonably determined by Omaze. Promoter reserves the right at any time to conduct maintenance for its systems that may suspend or otherwise impact access to a Promotion.

WARNING: ANY ATTEMPT BY YOU OR ANY OTHER INDIVIDUAL DELIBERATELY TO DAMAGE ANY WEBSITE ASSOCIATED WITH A PROMOTION OR UNDERMINE, OR ATTEMPT TO UNDERMINE, THE LEGITIMATE OPERATION OF A PROMOTION MAY BE A BREACH OF CRIMINAL AND CIVIL LAW, AND SHOULD SUCH AN ATTEMPT BE MADE, OMAZE RESERVES THE RIGHT TO CLAIM AGAINST AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. OMAZE RESERVES THE RIGHT TO DISQUALIFY ANY INDIVIDUAL IT FINDS TO BE ATTEMPTING TO TAMPER WITH OR UNDERMINE THE ENTRY PROCESS, THE SITE, AND/OR THE LEGITIMATE OPERATION OF THE PROMOTION; TO BREACH THE RULES; OR TO ACT IN AN UNSPORTSMANLIKE OR DISRUPTIVE MANNER OR WITH THE INTENT TO ANNOY, ABUSE, THREATEN, OR HARASS ANY OTHER PERSON. IF, FOR ANY REASON, THE PROMOTION CANNOT BE RUN AS PLANNED OR IF OMAZE DETERMINES THAT THE INTEGRITY OR VIABILITY OF THE PROMOTION IS COMPROMISED, OMAZE MAYVOID ANY SUSPECT ENTRIES AND (A) CANCEL OR TERMINATE THE PROMOTION (OR ANY PORTION THEREOF); (B) MODIFY THE PROMOTION OR SUSPEND THE PROMOTION TO ADDRESS THE IMPAIRMENT AND THEN RESUME THE PROMOTION IN A MANNER THAT BEST CONFORMS TO THE SPIRIT OF THESE RULES; AND/OR (C) AWARD THE PRIZE AT RANDOM FROM AMONG THE ELIGIBLE, NON-SUSPECT ENTRIES RECEIVED UP TO THE TIME OF THE IMPAIRMENT.

10. LIMITATION OF LIABILITY: Nothing in these Rules excludes or limits Omaze’s liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; and (iii) any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
If Omaze fails to comply with these Rules, Omaze will be responsible for the loss or damage Participant suffers that is a foreseeable result of Omaze’s breach of these Rules or its negligence, but Omaze is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by Participant and Omaze at the time that Participant entered this Promotion.

Notwithstanding the second paragraph of this section and save as set out in the first paragraph of this section, Omaze’s maximum liability to Participant under these terms, Omaze’s aggregate liability to Participant or any third party in any circumstance shall not exceed one hundred British pounds sterling (£100).

If for any reason, a Participant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant’s sole remedy is another entry in a Promotion.

11. GOVERNING LAW & JURISDICTION: These Rules are governed by the laws of England and Wales. This means that Participant’s participation in the Promotion and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims), will be governed by English law. Participants can bring proceedings in respect of these Rules in the English courts. However, as a consumer, if Participant lives in another part of the UK Participant can bring legal proceedings in respect of these Rules in either the English courts or Participant’s local courts.

12. PERSONAL INFORMATION: Promoter only uses Participant’s personal information in accordance with the Omaze privacy notice (available at https://omaze.co.uk/pages/privacy-notice). Please take the time to read the Privacy Notice as it includes important information and terms which apply to each Participant.
